Terms of Service

Article 1 (Application)

• These Terms apply to all aspects of Service use between users and the App.
• By using the Service, users are deemed to have agreed to these Terms.

Article 2 (Service Content)

The App provides the following services:

• Smart vocabulary learning based on forgetting curves
• Flashcard and quiz-style learning modes
• Multi-language flashcard decks (English, Spanish, Chinese, etc.)
• Custom flashcard deck creation and editing
• Learning progress tracking and statistics
• Review timing notification features
• Other related services as defined by the App

Article 3 (Usage Conditions)

• Basic features of the Service are available for free.
• Some premium features may be offered for a fee.
• Details of paid features can be found within the app.
• Payments are processed through each platform's payment system (App Store, Google Play, etc.).

Article 4 (Account Management)

• Users are responsible for accurately registering and properly managing their account information.
• The App is not responsible for damages arising from unauthorized use of account information.
• If you discover unauthorized use of your account by a third party, please contact us immediately.

Article 5 (Prohibited Activities)

Users must not engage in the following activities:

• Activities that violate laws or public order and morals
• Activities that place excessive burden on the App's systems
• Reverse engineering, decompiling, disassembling, etc.
• Activities that interfere with the App's operation
• Attempting unauthorized access or modification
• Copying, modifying, or redistributing the Service
• Unauthorized commercial use or resale
• Activities that cause inconvenience to other users
• Creating or sharing flashcard decks with inappropriate content
• Other activities deemed inappropriate by the App

Article 6 (Intellectual Property Rights)

• All content included in the App (learning algorithms, design, graphics, audio, text, flashcard data, etc.) and other intellectual property rights belong to BitFlap LLC or legitimate rights holders.
• Copyright of user-created flashcard decks belongs to the user, but the App may use them to the extent necessary for service provision.
• Users may not use, copy, or republish the App's content beyond the scope of private use.

Article 7 (Fees and Cancellation)

• Fees for paid features are displayed according to each platform's pricing.
• Subscription cancellations can be made through each platform's settings.
• Refunds are subject to each platform's terms.
• If payment cannot be confirmed, access to paid features may be suspended.

Article 8 (Service Changes and Discontinuation)

The App may change the Service content or discontinue provision without prior notice to users. The App assumes no responsibility for damages caused to users as a result.

Article 9 (Disclaimer)

• The App does not guarantee the completeness, accuracy, reliability, usefulness, etc., of the Service.
• The App assumes no responsibility for damages arising from use of the Service.
• The App is not responsible for damages caused by device malfunction, data loss, etc.
• The App does not guarantee that the Service is completely free of bugs or defects.
• Learning effectiveness varies by individual, and the App does not guarantee specific learning outcomes.

Article 10 (Damages)

If a user violates these Terms and causes damage to the App, the user is responsible for compensating such damage.

Article 11 (Personal Information Handling)

Personal information is handled appropriately according to our separate "Privacy Policy".

Article 12 (Terms Changes)

The App may change these Terms as necessary. Revised Terms take effect from the time they are posted within the app or on our website.

Article 13 (Governing Law and Jurisdiction)

• These Terms are governed by Japanese law.
• The Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes related to the Service.

Article 14 (Severability)

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain valid.
